Frequently Asked Questions

You need to transfer your funds after your immigration attorney has reviewed your source of funds documentation and before your I-526E application is submitted. The transfer is made according to a subscription agreement and into an escrow account established for the New Commercial Enterprise (NCE) linked to the project you choose.

You can conduct your own research or work with EB-5 consultants like our company. We provide a comprehensive overview from the start, explaining legislation, industry practices, and current trends, enabling you to make an informed decision.

You have two options:

  1. Wait for approval outside the U.S.:
In this case, it may take 1–3 years from the time of your initial application to when you can move to the U.S.
  2. Wait for approval while in the U.S.:
If you have a valid visa, you can remain in the U.S. and apply for an adjustment of status either concurrently with or after filing your I-526 petition.

Yes, loans and gifts can be used as sources of funds. For more details, refer to our article.

Most Regional Centers offer projects in Targeted Employment Areas (TEA), where the required investment amount is $800,000. Additional non-refundable expenses typically range from $100,000 to $150,000. These expenses include administrative fees charged by the project, immigration attorney fees, and government filing fees.

To minimize your risks, ensure you choose a Regional Center with a proven track record of success and engage an experienced EB-5 attorney to guide you through the process.
